This paper examines the efficacy of a statelessness reduction plan implemented by the country of Chile. We evaluate the programmatic alignment of Chile’s statelessness reduction plan, #Chilereconoce, with policy enacted by the United Nations High Commissioner for Refugees in that office’s campaign to eradicate statelessness by the year 2024. In addition to evaluating the structure of Chile’s statelessness reduction plan, we explore the policy outcomes of this plan in achieving its desired goal of reducing statelessness in Chile. We use Chile (...) as a case study because it implemented the United Nations High Commissioner for Refugees’ 2014-2024 Action Plan and, therefore, can shed light on if such a plan can put a nation-state on the path to remedy the deleterious effects of statelessness. Our central argument is that Chile’s statelessness reduction plan can, in-fact, serve as a blueprint for governmental institutions to follow towards achieving the goal of reducing statelessness. The success of such a plan, however, is conditioned upon whether principle actors within governmental institutions confront, head on, structural challenges that otherwise tend to undermine the merging of a confluence of critical factors that must be aligned for success to occur. The Chilean project demonstrates that reducing statelessness requires community action, implementation of domestic legislative reform, and governmental accession to international treaties. (shrink)

In the May, 1960, issue of the American Bar Association Journal (vol. 499), Morton Birnbaum, a lawyer and physician, argued for a legal right to psychiatric treatment of the involuntarily committed mentally ill person. In the 18 years since his article appeared,, there have been several key court cases in which this concept of a right to psychiatric treatment has figured prominently and decisively. It is important to note that the language of the decisions have had at least an indirect (...) effect in the recently enacted mental Hygiene Law of the State of New York. While I shall not seek to establish the historical thesis that Birnbaum’s article has been efficacious in bringing about both these court decisions and changes in statutory laws, I do want to examine Birnbaum’s article and some of the opinions for three cases: Wyatt v. Stickney (1972), Wyatt v. Aderholt (1974), and O’Connor v. Donaldson (422 US 563, 1975), in an effort to understand both the significance of these changes in our laws and the underlying philosophical and ethical notions of which they are an expression. Birnbaum observed that the notable feature of the legal situation at the time was that there had not been recognized a constitutional requirement that one who had been institutionalized for mental illness according to due process must receive treatment. Birnbaum argued that the effects of an omission of such a requirement to treat were that mental institutions typically offered only custodial care, that patients who were held only under custodial care typically did not improve, and that the result was that involuntary incarceration in a mental institution was, at least from the point of view of the patient, functionally no different than would be imprisonment for an unspecified period of time. Birnbaum argued for a recognition and enforcement in the courts of the right to treatment “...as a necessary and overdue development of our present concept of due process of law,” i.e., as required by the 14th Amendment to the U.S.. Neural crest cells are multipotent progenitors, capable of producing diverse cell types upon differentiation. Recent studies have identified significant heterogeneity in both the fates produced and genes expressed by different premigratory crest cells. While these cells may be specified toward particular fates prior to migration, transplant studies show that some may still be capable of respecification at this time. Here we summarize evidence that extracellular signals in the local environment may act to specify premigratory crest and thus generate diversity in (...) the population. Three main classes of signals–Wnts, BMP2/BMP4 and TGFβ1,2,3–have been shown to directly influence the production of particular neural crest cell fates, and all are expressed near the premigratory crest. This paper argues that ecofeminism can consolidate its tradition of elucidating the interconnections between different oppressions by expanding upon its philosophy of the body. By looking at the ways in which particular bodies become 'marked', and so devalued, ecofeminism can point towards various unexpected and creative coalitions. Here I concentrate especially upon two intertwined sets of markings, namely those related to aesthetic discourses and those related to discourses of Western reason. I argue that both of these ultimately revolve around notions (...) of control of the body as being constitutive of Western ideas of human identity. Moreover, I want to affirm that those ideas which encourage us to devalue certain bodies stem from discourses related to nature and animality. Through considering how ecofeminism might re-think embodiment, I argue for an alternative conception which stresses the inherent vulnerability and agency of human embodiment. (shrink)

Revenge is universal in human cultures, and is essentially personal and retributive. Its moral status is contested, as is its rationality. Revenge is traditionally associated with pleasure, but this association is not accounted for in contemporary philosophical treatments of revenge. Here I supply a theory of normal narcissistic functioning that can explain this association. Normal narcissism is an adaptive form of inter-psychic processing which has to do with the regulation of a coherent set of meta-representations of the agent. It can (...) be given a general account by integrating views drawn from clinical traditions, empirical psychology, and contemporary cognitive neuroscience. I explore the neural correlates of normal narcissism, its characteristic accompanying emotions and pleasures/displeasures, and its fundamental dynamics. It is proposed that this allostatic regulatory system plays a prominent role in retributive behavior, including revenge. Revenge is understood as a form of narcissistic repair, and a variety of puzzles concerning revenge are solved from this point of view. (shrink)

There is but a mere hint of how atomistic philosophy was handled by the Aristotelians and to what extent they actually absorbed some of that tradition themselves. Nothing in detail is said of the process whereby atomistic and Platonic motives became coupled, not only by Bruno, (...) but by Ficino before and by Cudworth afterwards. On the credit side, however, the author does call attention to the commentary and paraphrase of Lucretius by Girolamo Frachetta of Rovigo (printed 1589), a work of some interest, which has been but little studied. Such rays of light are all too infrequent in this section and Papi is usually content to follow the conventional beaten path. For one to write a book on Bruno which breaks new ground is now difficult, for the field has been so thoroughly worked over. This one takes up a number of interesting themes found in Bruno's writings and sheds some light on them, but it seldom if ever says anything very different from the well-established tradition of Bruno scholarship in Italy which has produced so many mediocre books over the years. The specialist on Bruno and the sixteenth century will find little to detain him; the more casual reader could be ~rected to a number of superior treatments of various aspects of the Nolan's thought. Pp. 733. $19.50) This excellent study, the fruit of more than a dozen years of research, throws much light on Ralegh's thought and literary achievement. Lefranc has examined the manuscript sources, and unearthed quite a few new ones, and has patiently, carefully, and with much detective work, established what is no doubt the best available hypothesis of what is authentic among Ralegh's purported prose and poetic writings, and the date and circumstances of their composition. He has analyzed them in the context of Ralegh's carver, and has developed an exciting and rich interpretation of his political, philosophical and religious ideas. Ralegh's role in intellectual history derives mainly from his reputation as a Machiavellian, as an atheist, and from his mammoth, "pious," much-read providential History of the World (written during his years as a prisoner in the Tower of London). Lefranc deftly sorts and weighs the evidence for the various views and attitudes attributed to Ralegh in his own day and by interpreters ever since, and emerges from this examination with a fresh and striking picture of one of the liveliest bridge figures between the Elizabethan Renaissance and the modern world. The establishment of the canon leads to discarding as not by Ralegh many writings that have previously been used in interpreting the courtier's views. Three philosophical works which have played a role in twentieth-century interpretation, "A Treatise of the Soule," "The Prince, or Maxims of State" and "The Sceptick" are shown to be doubtful to a greater or lesser degree. "The Sceptick," which Strathmann (Sir Walter Ralegh,,4 Study in Elizabethan Skepticism, New York, 1951) had used to interpret Ralegh as a sceptical-Christian fideist, had been questioned earlier by Lefranc, Sprott, and myself. It is just a translation of portions of Book I of Sextus F_znpiricus' Outlinea of Pyrrhonism, and contains no connection with Ralegh, except that it was BOOK REVIEWS 213 published in his literary remains in 1651. Lefranc now, examining the evidence of the four manuscripts that have been discovered, concludes that it was a part of Ralegh's documentation when he was doing his research, but that 'Tattribution de 'The Sceptick' Ralegh lui-m~me ne repose sur rien" (p. 67). With the canon shorn of the dubious items, Lefranc proceeds to unfold a picture of Ralegh's intellectual world. This article responds to a common criticism of Aristotelian naturalism known as the Pollyanna Problem, the objection that Aristotelian naturalism, when combined with recent empirical research, generates morally unacceptable conclusions. In developing a reply to this objection, I draw upon the conception of human nature developed by the ancient Chinese philosopher Mencius, and build up an account of ethical naturalism that provides a satisfying response to the Pollyanna Problem while also preserving what is most attractive about Aristotelian naturalism.

In Minkowski spacetime, because of the relativity of simultaneity to the inertial frame chosen, there is no unique world-at-an-instant. Thus the classical view that there is a unique set of events existing now in a three dimensional space cannot be sustained. The two solutions most often advanced are that the four-dimensional structure of events and processes is alone real, and that becoming present is not an objective part of reality; and that present existence is not an absolute notion, but is (...) relative to inertial frame; the world-at-an-instant is a three dimensional, but relative, reality. According to a third view, advanced by Robb, Capek and Stein, what is present at a given spacetime point is, strictly speaking, constituted by that point alone. I argue here against the first of these views that the four-dimensional universe cannot be said to exist now, already, or indeed at any time at all; so that talk of its existence or reality as if that precludes the existence or reality of the present is a non sequitur. The second view assumes that in relativistic physics time lapse is measured by the time co-ordinate function; against this I maintain that it is in fact measured by the proper time, as I argue by reference to the Twin Paradox. The third view, although formally correct, is tarnished by its unrealistic assumption of point-events. This makes it susceptible to paradox, and also sets it at variance with our normal intuitions of the present. I argue that a defensible concept of the present is nonetheless obtainable when account is taken of the non-instantaneity of events, including that of conscious awareness, as that region of spacetime comprised between the forward lightcone of the beginning of a small interval of proper time t and the backward lightcone of the end of that interval. This gives a serviceable notion of what is present to a given event of short duration, as well as saving our intuition of the “reality” or robustness of present events. (shrink)

The reappearance of the question of moral judgments by historians makes a reappraisal of the issues timely. Almost all that has been written on the subject addresses only the propriety of moral judgments in the written texts historians produce. However, historians have to make moral choices when selecting a subject upon which to write; and they make a tacit moral commitment to write and teach honestly. Historians usually dislike making explicit moral evaluations, and have little or no training in how (...) to do so. They can argue it’s not their job; they are only finders of fact. Historians holding a determinist view of actions do not think it appropriate to blame people for doing what they couldn’t help doing; for those believing there is an overall pattern to history, individual morality is beside the point. Finally, since earlier cultures had values different from ours, it seems unjust to hold them to contemporary standards. This essay modifies or rejects these arguments. Some historians have manifested ambivalence, acknowledging it is difficult or impossible to avoid making moral evaluations . Ordinary-language philosophers, noting that historiography has no specialized vocabulary, see it as saturated by the values inherent in everyday speech and thought. I argue that the historicist argument about the inevitably time-bound limitation of all values is exaggerated. Historians who believe in the religious grounding of values obviously disagree with it; but even on a secular level, morals are often confused with mores. If historians inevitably make moral evaluations, they should examine what philosophical ethicists—virtue ethicists, deontologists, and consequentialists—have said about how to make them; and even if they find no satisfactory grounding for their own moral attitudes, it is a brute fact that they have them. I end with an argument for “strong evaluations”—neither treating them as a troublesome residue in historiography nor, having despaired of finding a solid philosophical ground for moral evaluations, concluding that they are merely matters of taste. I believe historians should embrace the role of moral commentators, but that they should be aware that their evaluations are, like all historical judgments, subject to the criticisms of their colleagues and readers. Historians run little risk of being censorious and self-righteous; the far greater danger is acquiescing in or contributing to moral confusion and timidity. (shrink)

In this paper, I argue that the use of non-human animals in ritual sacrifices is not necessary for the Confucian tradition. I draw upon resources found within other religious traditions as well as Confucianism concerning carrying out even the most mundane, ordinary actions as expressions of reverence. I argue that this practice of manifesting deep reverence toward God through simple actions, which I call everyday reverence, reveals a way for Confucians to maintain the deep reverence that is essential for Confucianism, (...) while abandoning the use of non-human animal sacrifice. This paper consists in a study of Leibniz’s argument for the infinite plurality of substances, versions of which recur throughout his mature corpus. It goes roughly as follows: since every body is actually divided into further bodies, it is therefore not a unity but an infinite aggregate; the reality of an aggregate, however, reduces to the reality of the unities it presupposes; the reality of body, therefore, entails an actual infinity of constituent unities everywhere in it. I argue that this (...) depends on a generalized notion of aggregation, according to which a thing may be an aggregate of its constituents if every one of its actual parts presupposes such constituents, but is not composed from them. One of the premises of this argument is the reality of bodies. If this premise is denied, Leibniz’s argument for the infinitude of substances, and even of their plurality, cannot go through. In contrast with some recent theories of infinitesimals as non-Archimedean entities, Leibniz’s mature interpretation was fully in accord with the Archimedean Axiom: infinitesimals are fictions, whose treatment as entities incomparably smaller than finite quantities is justifiable wholly in terms of variable finite quantities that can be taken as small as desired, i.e. syncategorematically. In this paper I explain this syncategorematic interpretation, and how Leibniz used it to justify the calculus. I then compare it with the approach of Smooth Infinitesimal Analysis, (...) as propounded by John Bell. I find some salient differences, especially with regard to higher-order infinitesimals. I illustrate these differences by a consideration of how each approach might be applied to propositions of Newton’s Principia concerning the derivation of force laws for bodies orbiting in a circle and an ellipse. “If the Leibnizian calculus needs a rehabilitation because of too severe treatment by historians in the past half century, as Robinson suggests (1966, 250), I feel that the legitimate grounds for such a rehabilitation are to be found in the Leibnizian theory itself.”—(Bos 1974–1975, 82–83). Good Morning! When I was asked to talk on the subject of Dying in America at a breakfast meeting, It occurred to me that I might get to make some wisecracks about how we eat, at a breakfast where we would be served croissants, butter, sausage and eggs, and berries served with Devonshire cream: certainly the most tasteful form of dying in America! Nor have we been disappointed: quiche and ham should do quite nicely. Then, after last Tuesday’s election, someone (...) approached me and asked if my talk was gong to be on Democratic Party politics. I suppose the title “Dying in America: might fit that subject very nicely! Another wag asked whether I was going to discuss the Buffalo Bills’ current football season . . . . All of these possible applications of the phrase “Dying in America” point to the enormous importance we attach to the idea of dying, and the ways we use that idea in our very metaphorical language. That kind of richness of language is a sure sign, as Joseph Campbell would remind us, that culturally pervasive myths are constructed around the idea of dying. Now, I don’t intend to talk about Campbell’s views at all today, and I will avoid a short course on myths. But I will make just one or two observations about myths so that you are not uncomfortable with my later use of the term. For one of our myths about myths is that, in this educated and scientifically literate society, we don’t have any myths; myths are supposed to be the glue of fictional beliefs that holds primitive societies together, and we certainly are not primitive. Well, let me explain how I intend to use the idea of myth to illuminate some of our values and practices associated with the idea of dying in America. First, by a myth I mean a culturally pervasive set of beliefs and values that tends to center on a single, simple archetypal image or scenario. And second, by calling something mythic I mean to invoke perhaps a number of myths operating as a cluster of culturally important determinants of attitudes and behaviors.. (shrink)

It is well known that Leibniz advocated the actual infinite, but that he did not admit infinite collections or infinite numbers. But his assimilation of this account to the scholastic notion of the syncategorematic infinite has given rise to controversy. A common interpretation is that in mathematics Leibniz’s syncategorematic infinite is identical with the Aristotelian potential infinite, so that it applies only to ideal entities, and is therefore distinct from the actual infinite that applies to the actual world. Against this, (...) I argue in this paper that Leibniz’s actual infinite, understood syncategorematically, applies to any entities that are actually infinite in multitude, whether numbers, actual parts of matter, or monads. It signifies that there are more of them than can be assigned a number, but that there is no infinite number or collection of them, which notion involves a contradiction. Similarly, to say that a magnitude is actually infinitely small in the syncategorematic sense is to say that no matter how small a magnitude one takes, there is a smaller, but there are no actual infinitesimals. In geometry one may calculate with expressions apparently denoting such entities, on the understanding that they are fictions, standing for variable magnitudes that can be made arbitrarily small, so as to produce demonstrations that there is no error in the resulting expressions. References to human dignity abound in contemporary political, legal, and ethical documents and practices, including a widening representation in bioethical contexts. Appeals to dignity characteristically involve some notion of equality and the idea that there is some range of actions which ought never to be directed at persons . However, much of this contemporary use of dignity leaves the concept itself under-developed or poorly grounded. This sometimes conduces to a broadly skeptical view that dignity has any determinate content, or that (...) it can be grounded independently of either religion or rationalism. I argue that dignity has substantial connections to modern biological views of human beings, and that the biological matrix for dignity should be explored to help remedy these shortcomings. I propose three major biological contexts for understanding dignity in a naturalistic fashion: reciprocity and punishment, in so far as both are implicated in the promotion of pro-social cooperative behavior among humans, and dignity as a communicative signal that also has power to promote cooperation. Each of these three components is explored in some detail by reference to a wide range of contemporary scientific literature. Finally, I make suggestions for how it might be possible to study dignity in a fully scientific way, by adapting methods and techniques already well-established in biological, physiological, and neuroscientific study of human cooperation. This article is meant to be suggestive, not thorough, in the themes presented. It is suggestive of the ways in which an existential-phenomenological approach may contribute to an understanding of a fundamental therapeutic and lived issue. Beginning with a very brief description of what is experienced as fundamental in therapy, the ground on which all other issues depend, the developmental framework of Erikson was consulted since it was assumed that therapy was a reflection of life. The most fundamental issue for (...) Erikson was the crisis of basic trust versus basic mistrust. Trust was understood and revealed by him in terms of bodily trust, ego predictability and its social aspects. Using Heidegger's Care Structure as a framework, the absence of the existential, future-oriented characteristic of trust became apparent and the contribution of a phenomenological approach became visible. In using Erikson's word "hope" for this characteristic, it became apparent that not only was the future characteristic added but that within it the bodily and ego aspects could be integrated. Some phenomenological research was referred to which demonstrated that this integration was a fuller and more accurate reflection of human experience than the more specialized psychoanalytic understanding of Erikson. Marcel's description of hope was then consulted for a further understanding of this characteristic and finally the fundamental issue in therapy was identified as a crisis of hope. We use the word hope often in our daily experience. What this article points to as a research topic which would be central to therapy and to the lived world is what we mean when we say, "I hope." The structure of the experience of hoping would reveal much of what is central to both the world of therapy and the lived world. (shrink)

In this paper I offer a fresh interpretation of Leibniz’s theory of space, in which I explain the connection of his relational theory to both his mathematical theory of analysis situs and his theory of substance. I argue that the elements of his mature theory are not bare bodies (as on a standard relationalist view) nor bare points (as on an absolutist view), but situations. Regarded as an accident of an individual body, a situation is the complex of its angles (...) and distances to other co-existing bodies, founded in the representation or state of the substance or substances contained in the body. The complex of all such mutually compatible situations of co-existing bodies constitutes an order of situations, or instantaneous space. Because these relations of situation change from one instant to another, space is an accidental whole that is continuously changing and becoming something different, and therefore a phenomenon. As Leibniz explains to Clarke, it can be represented mathematically by supposing some set of existents hypothetically (and counterfactually) to remain in a fixed mutual relation of situation, and gauging all subsequent situations in terms of transformations with respect to this initial set. Space conceived in terms of such allowable transformations is the subject of Analysis Situs. Finally, insofar as space is conceived in abstraction from any bodies that might individuate the situations, it encompasses all possible relations of situation. This abstract space, the order of all possible situations, is an abstract entity, and therefore ideal. (shrink)

In speaking of a right in relation to identity formation, I have avoided many important questions, including questions about how properly to understand identity formation itself. Evoking such a right does draw from existing trends, but it remains speculative. Nonetheless, it captures one valuable insight in criticisms of human rights as a Western imposition, namely the insight that an important kind of oppression figures in the imposition of identities. By affirming a human right in relation to identity formation, we can (...) not only confront this kind of oppression but see that it has specific weight in contemporary globalizing politics, economics, and culture. Moreover, we see that human rights can offer a critical relation to that kind of identity assertion and cultural imperialism that has itself employed the language of universal principles. One reason to emphasize this possibility of human rights discourse is to explore how this discourse offers more generally a significant normative perspective for challenging various kinds of oppression and domination today. Emphasizing such possibilities is a way of exploring the respects in which any viable notion of democracy must provide an important place for human rights. (shrink)

Pippin offers his reconstruction of Hegel's account of practical reason as a point of departure for contemporary social theory, yet he does not address the implications for us of Hegel's claim that social reflection can achieve its knowledge only on the basis of a world that has already become rational. After arguing that the unreasonableness of our world can be seen from the suffering it generates, I argue that an account of violence may be a way to retrieve the promise (...) of Hegelian insights so long as it draws in turn on existing challenges to violence and the suffering it causes. The argument discusses four kinds of violence (direct, formative, structural, and symbolic) and confronts these with a neo-Hegelian conception of social learning. (shrink)

Before establishing his mature interpretation of infinitesimals as fictions, Gottfried Leibniz had advocated their existence as actually existing entities in the continuum. In this paper I trace the development of these early attempts, distinguishing three distinct phases in his interpretation of infinitesimals prior to his adopting a fictionalist interpretation: (i) (1669) the continuum consists of assignable points separated by unassignable gaps; (ii) (1670-71) the continuum is composed of an infinity of indivisible points, or parts smaller than any assignable, with no (...) gaps between them; (iii) (1672- 75) a continuous line is composed not of points but of infinitely many infinitesimal lines, each of which is divisible and proportional to a generating motion at an instant (conatus). In 1676, finally, Leibniz ceased to regard infinitesimals as actual, opting instead for an interpretation of them as fictitious entities which may be used as compendia loquendi to abbreviate mathematical reasonings. Russell’s most important source for his book on Leibniz was C. I. Gerhardt’s seven-volume Die philosophischen Schriften von Gottfried Wilhelm Leibniz. Russell heavily annotated his copy of this important edition of Leibniz’s works. The present paper records all Russell’s marginalia, with the exception of passages marked merely by vertical lines in the margin, and provides explanatory commentary.

Philosophical investigation of human nature has a long, distinguished, and multifaceted history. In the East some of the most heated philosophical disputes pertaining to issues concerning moral self-cultivation centered on disagreements about human nature. Within the Neo-Confucian tradition that developed out of Korea, issues concerning human nature took center stage in a dispute now known as the “Horak Debate” that began in the eighteenth century. In this paper I seek to introduce the Horak Debate to contemporary philosophers by (a) historically (...) situating the debate within the tradition of Korean NeoConfucianism, (b) providing an outline of the Horak Debate and identifying its central points of contention, and (c) demonstrating the debate’s philosophical significance by revealing how some of its key issues are rooted in disagreements that continue to concern contemporary philosophers.
